Artificial Intelligence Terms of Use

1. Acceptance of the Terms of Use

These Artificial Intelligence Terms of Use ("Terms") are made effective as of August 6, 2026 by and between you ("User") and White Rabbit Software LLC ("Company"). They govern the optional AI personality feature ("Service") in the Roomies app ("the App"). By enabling and using the Service, the User acknowledges that the User has read, understood, and agreed to be bound by these Terms. If the User does not agree, leave the Service disabled — the App works fully with pre-written ("canned") dialogue. These Terms supplement the Company's Privacy Policy.

2. What the Service is

The Service generates the User's virtual pet's dialogue using a small language model that runs on the User's device. Generated dialogue exists for entertainment only. The pet is a fictional game character, and nothing it says is factual information or advice of any kind.

3. Age requirements; children and families

The App is designed for general audiences, including children ages 4 and up. The Company builds the Service with families in mind: dialogue is constrained to the pet's character, filtered for appropriateness, and processed entirely on the device, and the Company does not collect, receive, or store personal information from any user, child or adult.

If the User is under the age of majority in their jurisdiction, a parent or legal guardian must accept these Terms on the User's behalf. Enabling the Service on a device used by a child constitutes a representation that the person enabling it is that child's parent or legal guardian (or has their permission) and accepts these Terms on the child's behalf. Parents and guardians can disable the Service at any time in Settings, which limits the pet to pre-written dialogue.

4. Use of the Service

The User agrees to use the Service only for lawful purposes and in compliance with all applicable laws and regulations. By using the Service, the User agrees not to engage in any activities that:

(a) Violate any applicable federal, state, local, or international laws or regulations, including those pertaining to the export of data or software to and from the United States or other countries.

(b) Attempt to manipulate the Service into producing harmful, unlawful, or infringing content.

(c) Impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity, including representing generated dialogue as human-authored or as statements of the Company.

(d) Engage in any conduct that may harm the Company or its users or expose the Company to legal liability, including using generated dialogue to harass or deceive others.

(e) Interfere with or disrupt the functioning of the Service or violate the rights of others.

(f) Use the Service or its outputs to develop machine learning models or related technology.

5. Content

Dialogue generated by the Service ("Output") is produced on the User's device from the pet's state and the User's in-app interactions ("Input"). Input and Output are collectively "Content." Output is produced by a statistical model and is inherently unpredictable: it may occasionally be inaccurate, nonsensical, out of character, or otherwise unexpected, and it is not, and must never be treated as, medical, mental-health, legal, financial, safety, or any other professional advice.

The Company applies content filters and design constraints on a best-effort basis; no filtering system catches every possible output, and the User accepts the risk of occasional unexpected content. Given the nature of machine learning, Output may not be exclusive, and the Service might produce similar or identical results for other users. Responsibility for any use of Content outside the App rests solely with the User, and the User should disclose that such Content was generated using artificial intelligence tools.

6. Intellectual property

All intellectual property rights related to the Service and the App — including but not limited to software, the model configuration, pre-written dialogue, and trademarks — are owned by or licensed to the Company. As between the parties, rights in Output generated on the User's device belong to the User, and the User may use Output for personal, non-commercial purposes.

7. Privacy; on-device processing

The Company believes strongly in the protection of privacy. The language model runs entirely on the User's device. The User's interactions with the pet, the pet's dialogue, and anything the pet learns are processed and stored locally on the device. The Company does not collect, receive, store, or review the User's conversations or personal information unless voluntarily provided (for example, by emailing the Company). The App connects to the internet for the Service only to download the model file and its version manifest. Data practices are further described in the Privacy Policy.

8. Accuracy and limitation of liability

The Service is provided on an "as is" and "as available" basis, and the Company makes no warranties or representations regarding its accuracy, reliability, or suitability for any purpose, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. The User accepts that the Company is not liable for Content quality failures related to inaccurate output, performance-related failures, or other quality-based issues. The information produced by the Service is intended for entertainment purposes only, and any reliance the User places on it is strictly at the User's own risk.

To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from or in connection with use of the Service or any Content, even if advised of the possibility of such damages. The Company's total aggregate liability arising out of or relating to the Service shall not exceed the greater of the amount the User paid the Company for the App in the twelve months before the claim or ten US dollars ($10).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to the User.

9. Indemnification

The User agrees to indemnify and hold the Company harmless from all claims, losses, expenses, and fees, including attorney fees, costs, and judgments that may be asserted against the Company that result from the acts or omissions of the User or the User's employees, agents, or representatives, including the User's misuse of the Service or violation of these Terms.

10. Termination

The Company reserves the right to discontinue, suspend, or modify the Service (including by model or app updates) at any time without prior notice for any reason, including violation of these Terms. The User may stop using the Service at any time by disabling the AI personality in Settings.

11. Amendment

The Company reserves the right to change these Terms from time to time. When the Company makes material changes, the App asks the User to review and accept the updated version before the Service continues; acceptance of the updated Terms constitutes agreement to be bound by them. The User's continued use of the Service after such acceptance constitutes acknowledgment of the modified Terms.

12. Alternative dispute resolution

The parties will attempt to resolve any dispute arising out of or relating to these Terms through friendly negotiations. If the matter is not resolved by negotiation, the parties agree to try in good faith to settle the dispute by mediation in accordance with any statutory rules of mediation before resorting to litigation.

13. Governing law

All matters relating to the Company and these Terms, and any dispute or claim arising therefrom or related thereto, shall be governed by and construed in accordance with the laws of the State of Michigan.

14. Entire agreement

These Terms constitute the entire agreement between the User and the Company with respect to the Service and, without prejudice to the Company's data and privacy policies, supersede all prior or contemporaneous understandings and agreements, whether written or oral, with respect to the Service.

15. Headings

Headings used in these Terms are provided for convenience only and shall not be used to construe meaning or intent.

16. Disclaimer

The Service uses experimental technology, and the User should use discretion before relying on any Content generated by the Service. The Company makes no guarantees regarding the accuracy, completeness, or usefulness of generated Content and assumes no liability or responsibility for any reliance placed on it by the User or any other person.

17. Reporting problems; contact

If your pet says something that seems inappropriate, harmful, or broken, contact the Company with what was said and roughly when, and the Company will investigate.
